By creating an account, signing in, or using ASCEND in any way, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not create an account or use the app. If you are using ASCEND on behalf of an organization, you represent that you have authority to bind that organization to these terms.
ASCEND is a personal growth journaling application that offers text and voice journaling, AI-powered insights, growth tracking, focus journals, monthly and yearly reflections, gamification features, and optional one-on-one coaching for premium subscribers. The service is provided on a subscription basis with three tiers: Basic ($10/mo), Premium ($49/mo), and Elite ($99/mo).
Important: ASCEND is a journaling and self-reflection tool. It is not a medical, psychological, or therapeutic service. It does not diagnose, treat, or cure any mental health or medical condition. The AI insights are informational only and may be inaccurate. If you are experiencing a mental health crisis, thoughts of self-harm, or any medical emergency, contact a licensed professional or emergency services immediately. You are responsible for all content you create and all activity under your account. You agree not to:
Insights, reflections, mood scores, and analysis generated by our AI are produced automatically and may contain errors, inaccuracies, or biased outputs. You should not rely on them as professional medical, psychological, legal, or financial advice. We are not liable for decisions made based on AI-generated content. Always consult a qualified professional for important decisions.
Your content: You retain full ownership of your journal entries, goals, reflections, and any other content you create ("User Content"). You grant ASCEND a worldwide, non-exclusive, royalty-free license to use, process, and display your User Content solely to provide and improve the service for you.
Our content: ASCEND, including its design, features, branding, and software, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the app without our written permission.
AI training: Your User Content may be processed by AI models to generate insights for you. We do not use your individual journal entries to train public AI models. Aggregated, de-identified data may be used to improve our services.
One-on-one coaching is available to Premium and Elite subscribers. Coaching sessions are provided for personal growth, motivation, and goal-setting purposes only. Our coaches are not licensed therapists, psychologists, or medical professionals unless explicitly stated in their credentials. Coaching is not a substitute for professional mental health treatment. If you need clinical support, please consult a licensed professional. Coaching sessions are subject to availability, and we reserve the right to reschedule or cancel sessions with reasonable notice.
ASCEND integrates with third-party services including Google (authentication and calendar), Stripe (payments), and AI providers. We are not responsible for the practices or content of these third parties. Your use of third-party services is subject to their respective terms and privacy policies. We are not liable for any damages resulting from third-party services.
You may delete your account and all associated data at any time from Settings. Upon deletion, your data will be permanently removed within 30 days. We may suspend or terminate your account if you violate these terms, engage in abusive behavior, or for any other reason with reasonable notice. Upon termination, your right to use the app ceases immediately.
You agree to indemnify, defend, and hold harmless ASCEND, its officers, directors, employees, and affiliates from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the app, (b) your violation of these terms, (c) your infringement of others' rights, or (d) your User Content. We reserve the right to assume the exclusive defense of any claim for which we are entitled to indemnification, and you will cooperate with us in such defense.
ASCEND is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the app will be uninterrupted, error-free, or secure.
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the app. Our total aggregate liability for all claims arising from these terms or your use of the app is limited to the amount you paid us in the preceding 12 months.
Because ASCEND involves journaling about mental health and personal matters, you acknowledge that the app is not a crisis service and that we are not liable for any harm resulting from reliance on the app in lieu of professional mental health care.
We are not liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, pandemic, government action, labor disputes, internet or telecommunications failures, or power outages.
Informal resolution: Before filing a claim, you agree to first contact us and attempt to resolve the dispute informally for at least 30 days.
Binding arbitration: Except for small claims court matters, any dispute or claim arising from these terms or your use of ASCEND will be resolved through final and binding arbitration rather than in court. Arbitration will be conducted by a single arbitrator under the rules of the American Arbitration Association (AAA). The arbitration will take place in the United States. Judgment on the arbitration award may be entered in any court with jurisdiction.
Class action waiver: You and we agree that each may bring claims against the other only on an individual basis, and not as a plaintiff or class member in any class, consolidated, or representative action. The arbitrator may not consolidate more than one person's claims.
Opt-out: You may opt out of this arbitration agreement by sending written notice to Base44 support within 30 days of accepting these terms.
We may update these terms from time to time. We will notify you of material changes via the app or email at least 30 days before they take effect. Continued use after the effective date constitutes acceptance of the updated terms. If you do not agree to the changes, you may cancel your subscription and stop using the app.
These terms are governed by the laws of the United States and the state in which ASCEND operates, without regard to conflict of law principles. For users outside the United States, local mandatory consumer protection laws may apply. Disputes will be resolved as described in Section 15.
If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and ASCEND regarding your use of the app. If any provision conflicts with an order or separate agreement you have with us, the order or separate agreement controls.
